Client Approval Form 

Home Builders Foundation (HBF) is a 501(c)(3) non-profit organization whose mission is to build independence, provide opportunities, and elevate lives for individuals and families with disabilities in our community. The foundation uses the unique resources of the home building industry to complete projects that make everyday life easier for individuals and families across the Denver metro area.


HBF staff and volunteers have received your completed application for assistance. The next step in our process is to conduct a site visit at your home. In order to move to the next phase in our process after the site visit, we need you to review the following pages and submit the signed forms. Your request for assistance will then be reviewed by the HBF Project Fulfillment Committee and evaluated against HBF’s criteria and guidelines.  

 

If approved, we will contact you with an update on timing and work item(s) approved, as well as the Project Captain/ Contractors doing the work. The Project Captain/ Contractors will schedule the work completion and be your main point of contact until the project is complete. Keep in mind that all HBF projects are unique, so please allow for flexibility within the overall project, as well as patience and flexibility with scheduling as the crew completing work are HBF volunteers doing this work for you. HOMEOWNER RELEASE AND WAIVER - Workmanship 

Home Builders Foundation (“HBF”) is a charitable, Denver-based nonprofit whose mission is to build independence, provide opportunities, and elevate lives for individuals and families with disabilities in our community. HBF will enlist one or more Project Captains/ Contractors/ Staff (“Contractor”) to complete modification at the residence listed. The “Contractor” may seek the assistance of subcontractors, architects, engineers, suppliers, and other persons and entities, and HBF may also rely on skilled and unskilled volunteers (“Volunteer" or "Volunteers”) to provide necessary labor and support for on-site construction and other assistance. Together, HBF, Contractor, Volunteers, and the other above-referenced persons and entities are hereinafter collectively referred to as the “Released Parties.” To the greatest extent permitted by law, and for and in consideration of the actions taken by HBF and for performance of the Work, the Owner/Client thereby releases, waives, and forever discharges any and all claims, suits, actions, causes of action, damages, and liabilities, whether known or unknown, now or in the future, against the Released Parties, their shareholders, directors, officers, agents, members, partners, attorneys, and employees, arising from performance of the Work or any matter incidental thereto, including without limitation, matters caused by, compounded by, or related to, the Work or any part thereof. The Owner/Client further agrees to indemnify and hold harmless HBF and/or any of its staff, subcontractors, architects, engineers, suppliers, volunteers, and/or other persons and entities, against all claims, demands, judgments and executions the Owner/Client or any of the Owner/ Client’s business and/or social guests may sustain as a result of, or arising out of the Work, described above, whether or not such claims, demands, actions, judgments and executions are discovered during the period that HBF is performing the Work at the Residence.


Owner specifically acknowledges that no Released Parties shall be liable for harm caused by an act or omission of the volunteer on behalf of HBF if: 

 

  1. (1)   The Released Parties was acting within the scope of the Released Parties’ responsibilities for HBF at the time of the act or omission;

     

    (2)   The Released Parties, if applicable, was properly licensed, certified, or authorized by the appropriate authorities for the activities or practice in the State of Colorado, where the activities were, or practice was undertaken within the scope of the Released Parties’ responsibilities for HBF;

     

    (3)   The harm was not caused by willful or criminal misconduct, gross negligence, reckless misconduct, or a conscious, flagrant indifference to the rights or safety of the individual harmed by the Released Parties; and

     

    (4)   The harm was not caused by the Released Parties operating a motor vehicle, vessel, aircraft or other vehicle for which the State of Colorado requires the operator or owner of the vehicle, craft, or vessel to:

     

    (A)  Possess an operator’s license; or

  2. (B)  Maintain insurance.       


The activities of the Released Parties would not have been undertaken or pursued without the Owner/Client's agreement to the release and waiver set forth above. 

 

THE HOMEOWNER/ CLIENT AGREES TO (must check all as acknowledgement) –   

COVID-19

As a result of the outbreak of the novel Coronavirus (COVID-19), our organization is taking additional precautions with regard to all projects following sanitation and disinfecting requirements in accordance with federal CDC protocols. 

 Symptoms of COVID-19 include: 

•Fever 

•Fatigue 

•Dry cough 

•Difficulty breathing  

If any of the following conditions are not met on the day of the site visit or any day during which project work is being performed, I will notify HBF and reschedule the HBF project when the conditions are met. 

  • I understand the above symptoms and affirm that I, as well as all household members do not currently have the symptoms identified above. 
  • I understand affirm that all household members will follow the latest COVID-19 guidelines by the CDC if exposed to COVID-19 or if tested positive.  
  • I understand that Home Builders Foundation cannot be held liable for any exposure to the COVID-19 virus caused by misinformation on this form or the health history provided by each participant in this or any project. 

Our organization is following these enhanced procedures to prevent the spread of COVID-19: 

  • State of Colorado and any local mandates regarding COVID transmission will be followed.. 
  • Halting any projects in or outside of a home in which any of the above conditions apply to the residents of the home or the workers completing the project. 

 
By entering my name below, I agree to each statement above and release the Home Builders Foundation from any and all liability for unintentional exposure or harm from COVID-19.  

Media Release


1. I hereby grant full permission to HBF to prepare, use, reproduce, publish, distribute, and exhibit the items checked above in or in connection with the production of promotional videos, web sites, social media, still photography, motion picture films, television tapes, film or sound track recordings, publications for informational purposes, news media releases, or any other purpose deemed necessary in the interest of the mission of HBF whether now known or hereafter devised. 


2. I hereby waive all rights of privacy or compensation, which I may have in connection with the use of the items checked above in or in connection with said promotional videos, web sites, still photography, motion picture films, television tapes, film or sound track recordings, publications for informational purposes, news media releases and any use to which the same or any material therein may be put, applied or adapted by HBF. 


3. I hereby release and transfer to HBF and any of its agents, all rights regarding the above-mentioned material to copyright or trademark the same in its own name or otherwise. 


4. I enter into this Release under Colorado law, and understand and agree that it is intended to be as full, complete, and broad as Colorado law allows. I agree any dispute related to or involving this Release shall be subject to arbitration in Denver, Colorado, in accordance with the rules of Judicial Arbitration & Mediation Services (JAMS). The arbitrator shall have full authority to provide injunctive relief, including temporary or permanent restraining orders, and other equitable relief, which shall be enforceable through the District Court of Denver, Colorado, as any other judgment in accordance with the Colorado Rules of Civil Procedure. I agree that any provision of this release is held to be invalid, nevertheless, the balance of the release shall continue in full force and effect.


5. This Release may be revoked by the undersigned at any time, following which HBF shall not use the items checked above in any future materials; provided, however, that HBF shall not be prohibited from the use of materials prepared prior to the revocation date of this release.




The Owner/Client represents and agrees as follows: that he/she has read and understands the contents of this document; that he/she has executed this document voluntarily after having had the opportunity to discuss it with his/her legal counsel; and that he/she has not been influenced by any person or attorney acting on behalf of any of the Released Parties or any representative thereof. This document shall be binding upon the Owner and his/her heirs, personal representatives, successors and assigns.
